Nawala ang aking pasaporte. Ano ang dapat kong gawin?

Kung kailangan ninyong bumalik ng Pilipinas ng agaran, maaari kayong mag-apply ng Travel Document na magagamit sa loob ng 30 araw mula sa araw ng pagkakaloob. May bisa ang dokumentong ito para lamang sa one-way travel papuntang Pilipinas. Narito ang proseso upang makakuha ng Travel Document. Maaari kayong mag-apply ng bagong pasaporte sa Pilipinas dala ang Travel Document. 

Kung makakahintay kayo ng hanggang anim (6) na linggo, maaari kayong mag-apply ng bagong pasaporte sa Pasuguan at ideklarang “lost” ang inyong pasaporte. Narito ang proseso upang makakuha ng pasaporte. 

Huwag kalimutang dalhin ang mga karagdagang dokumento para sa mga nawalang pasaporte.

I lost my passport. What should I do?

If you need to return to the Philippines immediately, you may apply for a Travel Document, which you can use within 30 days from the date of issue. This document is only valid for aone-way travel to the Philippines. You may find on this link the process for getting a Travel Document. You may then apply for a new passport upon return to the Philippines using your Travel Document.

If you can wait for up to six (6) weeks, you may apply for a new passport at the Embassy and declare your previous passport it as “lost”. Click on this link for the process on getting a new passport. 

Remember to bring the additional documents required for lost passports.

I have recently gotten married. How do I change my surname on my passport?

You need to apply for a new passport, presenting your Marriage Certificate or your Report of Marriage from the Philippine Statistics Authority (PSA).

If you were married in Belgium/Luxembourg, you first need to register your marriage at the Embassy through the Report of Marriage. Click here for the process of Reporting your Marriage. After registration, you will then have to apply with the PSA for a copy of your Report of Marriage.

 

 

Visa

I want to go on vacation to the Philippines for more than 30 days. Do I need a visa?

Ako ay dating Pilipino at gusto kong magbakasyon sa Pilipinas. Ako ba at ang aking asawang Belgian/Luxembourgish ay kailangang mag-apply ng visa?

I am a former Filipino and I wish to take a vacation to the Philippines. Do my Belgian/Luxembourgish spouse and I need visas?

No. With the Balikbayan Program, you can stay in the Philippines for up to one year. You just need to show Immigration officials proof that you are a former Filipino.

You and your spouse should be traveling together from him/her to avail of the Program.

Kailangan ng inyong kamag-anak/kaibigan ng Belgian visa. Para dito, mangyaring sumangguni sa Pasuguan ng Belgium sa Maynila.

 

Do my family/friends need to apply for a visa if they wish to come to Belgium/Luxembourg? What are the requirements?

They need a visa. They should refer to the instructions of the Embassy of Belgium in Manila in getting a Belgian visa.




Civil Registry

Pwede ba akong kumuha sa Pasuguan ng kopya ng PSA Birth Certificate / Certificate of No Marriage (CENOMAR) / Marriage Certificate / Death Certificate? Pwede ko rin bang ipa-apostille ang mga ito sa Pasuguan?

Hindi po. Ang Birth Certificate, CENOMAR, Marriage Certificate at Death Certificate ay mga civil registry document na makukuha lamang sa Philippine Statistics Authority (PSA) sa pamamagitan ng pagpunta sa website ng PSA Serbilis. (https://www.psaserbilis.com.ph/).

Sa PSA Serbilis, maaari kayong mag-request ng mga civil registry document. Ang PSA na ang magpapadala ng mga ito sa inyong napiling address. Maaari rin itong ipadala sa inyo sa Belgium/Luxembourg sa pamamagitan ng courier.

Ang apostille naman ay ginagawa lamang sa Office of Consular Affairs (OCA) ng Department of Foreign Affairs sa Maynila, o di kaya’y sa ilang Consular Offices sa Pilipinas. Narito ang listahan ng Consular Offices na nagbibigay ng apostille services.

Maaari kayong magtalaga ng taong tatanggap ng inyong mga civil registry documents at magpapa-apostille ng mga ito sa pamamagitan ng Special Power of Attorney (SPA). Maaari kayong magpanotaryo ng SPA dito sa Pasuguan. I-click ang link na ito para sa proseso upang makakuha ng Special Power of Attorney (SPA).

Maliban dito, mayroon na ring pasilidad na Electronic Apostille o e-Apostille, kung saan maaaring mag-apply at makatanggap ng PSA e-Certificate na may electronic apostille sa inyong email. Can I get a copy of the PSA Birth Certificate / Certificate of No Marriage (CENOMAR) / Marriage Certificate / Death Certificate at the Embassy? Can I also have these apostillized at the Embassy?

No. The Birth Certificate, CENOMAR, Marriage Certificate and Death Certificate are civil registry documents that can only be requested and secured from the Philippine Statistics Authority (PSA) by going to the website of PSA Serbilis (https://www.psaserbilis.com.ph/).

You may request civil registry documents through PSA Serbilis. Through this service, you may also have your documents delivered to your chosen address. They can also send the documents to Belgium/Luxembourg through a courier.

Meanwhile, apostillization can only be done at the Office of Consular Affairs (OCA) of the Department of Foreign Affairs in Manila, or at certain Consular Offices in the Philippines. You may find on this link the list of Consular Offices that provide apostille services.

You may authorize someone to receive your civil registry documents and have these apostilled through a Special Power of Attorney (SPA). You may have the SPA notarized at the Embassy. Click on this link for the process on getting a Special Power of Attorney (SPA).

Aside from the above, the facility for an Electronic Apostille or e-Apostille is now online. Through this facility, you may apply for and receive a PSA e-Certificate with an electronic apostille through your email. Please go to https://psahelpline.ph/dfa-oca for more information. Please check with the end-user first if they will accept an e-Apostille and a PSA e-Certificate.

 


 

May anak po kami ng aking asawa/partner na Belgian/Luxembourgish. Ipinanganak ang aking anak dito sa Belgium/Luxembourg. Paano ko siya makukuhanan ng pasaporte ng Pilipinas?

Una, kailangang mapatunayang kayo ay isang Filipino citizen noong ipinanganak ang inyong anak. Kung kayo po ay naging naturalized Belgian/Luxembourgish citizen na noong ipinanganak ang inyong anak, kailangan muna ninyo muling makuha ang inyong Philippine citizenship sa pamamagitan ng Republic Act No. 9225, o ang Citizenship Retention and Reacquisition Act. Narito ang mga pamamaraan upang makakuha kayo ng dual citizenship.

Kung mapatunayang kayo ay Filipino citizen noong ipinanganak ang inyong anak (maaari itong mapatunayan sa birth certificate ng inyong anak), kailangan muna ninyong i-report ang kanyang kapanganakan sa pamamagitan ng Report of Birth. Narito ang mga pamamaraan upang makuhanan ang inyong anak ng Report of Birth.

Kapag nakapagsumite na kayo ng at na-proseso na ang Report of Birth ng inyong anak, dito pa lamang siya maaaring makapag-apply upang makakuha ng pasaporte ng Pilipinas. 

 

I have a child with my Belgian/Luxembourgish spouse/partner. My child was born here in Belgium/Luxembourg. What should I do to get my child a Philippine passport?

To be able to do so, it must be proven that you were a Filipino citizen at the time of your child’s birth. If you were already a naturalized Belgian/Luxembourgish citizen when your child was born, you must first apply for the retention or reacquisition of your Philippine citizenship through Republic Act No. 9225, or the Citizenship Retention and Reacquisition Act. Click on this link for the procedures to retain or reacquire your Philippine citizenship.

If there is proof that you were a Filipino citizen at the time of your child’s birth (e.g., on your child’s birth certificate), you first need to inform the Embassy of your child’s birth through the Report of Birth. Click here for instructions on how to get a Report of Birth for your child.

Only when your child’s Report of Birth has been processed can s/he apply for a Philippine passport.


 

Ako ay Pilipino at divorced sa aking dating asawang Belgian/Luxembourgish. Maaari ba akong magpakasal muli?

Kung kayo ay divorced sa inyong foreign spouse, maaari kayong kumuha ng Judicial Recognition of Foreign Divorce upang mai-reflect ito sa inyong civil registry documents (Certificate of Marriage o Report of Marriage at CENOMAR).

Kailangan munang i-file ang petisyong ito sa Regional Trial Court sa Pilipinas. Kapag na-recognize na sa korte ang foreign divorce decree, irerehistro naman sa Local Civil Registry Office (LCRO) ang desisyon ng korte. Isusumite ang dokumento sa LCR kung saan inirehistro ang kasal. Kung sa ibang bansa nagparehistro ng kasal, isusumite ang dokumento sa City Civil Registry Office sa Maynila. 

Para sa karagdagang impormasyon at serbisyong legal, tulad ng paghahanap ng abugado sa Pilipinas, maaaring sumangguni sa website ng Integrated Bar of the Philippines (IBP) o ng Public Attorney’s Office (PAO).

I am a Filipino who is divorced from my Belgian/Luxembourgish spouse. Am I allowed to remarry?

If you are divorced from your foreign spouse, you may secure a Judicial Recognition of Foreign Divorce so that it can be reflected on your civil registry documents (Certificate of Marriage or Report of Marriage at CENOMAR).

To do so, the petition for recognition of foreign divorce must be filed at the Regional Trial Court (RTC) in the Philippines. Once the foreign divorce decree is recognized, the court decision will then be registered at the Local Civil Registry Office (LCRO) where the concerned RTC functions. The registered document shall be submitted to the Local Civil Registrar where the marriage was registered. If the marriage was registered overseas, the registered document shall be submitted to the City Civil Registry Office at the Manila City Hall (CCRO-Manila).

I am newly arrived in Belgium/Luxembourg from another country. There’s an employer who wants to hire me. What should I do to get a work permit?

Your employer needs to go to your commune/gemeente to apply for your single permit.

Please note that the single permit may have requirements that you may not be able to meet, such as the type of work you will undertake and your immigration status here in Belgium/Luxembourg.

Mayroon po akong residence/A1 permit na bigay ng aking employer sa ibang bansa. Pwede po ba akong magtrabaho dito sa Belgium? Mahigit 6 na buwan na ako dito.

Ang A1 permit ay ebidensya na ang isang manggagawa ay napasailalim ng Social Security system ng pinanggalingang Member State ng European Union (EU). Gamit ang A1 permit, maaaring ipadala ng isang employer ang kanyang worker upang makapagtrabaho ng pansamantala sa ibang EU Member State. Subalit kailangang magparehistro ng residence ang worker sa mga awtoridad kung lalagpas sa tatlong (3) buwan ang kanilang posting. Kung nakatira kayo sa Belgium ng higit sa 3 buwan, kailangan ninyong tanungin ang inyong employer upang irehistro kayo bilang residente sa town hall ng lugar kung saan kayo nakatira.



I have a residence/A1 permit from my employer in another country. Can I work here in Belgium? I have been living here for more than 6 months.

The A1 permit is evidence that workers are subject to the Social Security system of the sending Member State of the European Union (EU). With this permit, an employer can send their workers to work temporarily in another EU Member State. However, the workers are required to register their residence with the authorities if their posting is longer than three (3) months. If you have been living in Belgium for more than 3 months, you have to ask your employer to register you as a resident at the town hall in the place where you reside.

Ano po ba ang mga kailangan kong dalhin para hindi ako ma-hold ng Immigration officers sa airport sa Pilipinas?

Ang basic requirements upang makalabas ng Pilipinas ay ang:

  1. Pasaporteng valid ng di-bababa sa anim (6) na buwan mula petsa ng pag-alis;
  2. Appropriate valid visa, whenever required;
  3. Valid ID;
  4. Boarding pass; at
  5. Kumpirmadong return o round-trip ticket, kung kinakailangan.

Maaari kayong hanapan ng karagdagang requirement ng Immigration officer, depende sa kung bakit kayo lalabas ng Pilipinas (papuntang Belgium/Luxembourg).

Kung kayo ay OFW: Lahat ng paalis na OFW, bagong hire man o Balik Manggagawa, ay kailangan ng Overseas Employment Certificate (OEC). Magsisilbi itong exit clearance at exemption upang hindi na magbayad ng travel tax at airport terminal fee. Maaari ninyo itong makuha online: https://onlineservices.dmw.gov.ph/OnlineServices/POEAOnline.aspx. Dalhin din ang valid at tamang employment visa o work permit.

Kung kayo ay turista: Kailangan ninyo ng visa at ng mga karagdagang dokumentong makakapagsuporta sa inyong purpose of travel, gaya ng pruweba ng hotel booking/accommodation, proof of employment, o source of income. 

Kung suportado naman ng inyong kakilala ang inyong biyahe, kailangan ninyo ng karagdagang pruweba na kaya kayong suportahan ng inyong sponsor, gaya ng Affidavit of Support, employment certificate ng inyong sponsor, at iba pa. Narito ang mga patakaran at mga requirement para makapag-notaryo ng Affidavit of Support sa Embassy.

 

What do I need to bring so that I will not be held up by the Immigration officers at the airport in the Philippines?

The following are the basic requirements to be able to leave the Philippines:

  1. Passport, valid at least six (6) months from the date of departure;
  2. Appropriate valid visa, whenever required;
  3. Valid ID;
  4. Boarding pass; and
  5. Confirmed return or round-trip ticket, when necessary.

If you are an OFW: All departing OFWs, whether new hires or Balik Manggagawa, are required to secure an Overseas Employment Certificate (OEC), which shall serve as exit clearance and as exemption from payment of travel tax and airport terminal fee. If you are a tourist: Aside from the tourist visa, you may need additional supporting documents such as, but not limited to, proof of hotel booking/accommodation, proof of employment, or source of income.

If you are supported by a family member or a friend for your travel, you need to show additional proof that your sponsor will be able to provide for you, such as an Affidavit of Support, your sponsor’s employment certificate, etc. Here are the procedures and requirements for having your Affidavit of Support notarized at the Embassy.

Maaaring ma-exempt ang mga sumusunod sa pagbabayad ng travel tax: Overseas Filipino workers, mga Pilipinong permanent resident sa ibang bansa na mananatili sa Pilipinas ng di-lalagpas sa isang taon, at mga sanggol hanggang dalawang (2) taong gulang.
